Birds: getting rid of the pests?

A birds has nested directly above my bedroom window in a crevasse under the roof. It is a constant annoyance. The bird leaves the nest every ten minutes or so. Everytime in exits and enters the nest its wings flap against my window and causes quite a loud noise; furthermore, when it is in the nest it is constantly chirpping.

It is not possible for me to get in the crevasse and remove the nest. I would have no qualms w/ killing it, I imagine that would be the only permanent fix. Any ideas on how to go about doing this? An air gun is not an option b/c I live in a pretty highly populalated area so I obviously cannot lay in wait outside w/ an air rifle w/o looking criminal. Any help would be appreciated. Thanks.
Problem solved. I would thank you for your answers but all of you gave terrible advice. Ear plugs?...in my own home...ya right. Now, a moment of silence for our fallen feathered friend...

If you destroy this nest or harm the bird...you would be a criminal. This is against the law and you could be fined or imprisoned. There is a law called the Migratory Bird Treaty Act that forbids harm to native birds or nests. It sounds like the chirpping you hear when the bird is in the nest is babies making begging sounds. This means the birds will be leaving the nest soon. Most passerine birds only stay in the nest for about 2 weeks..so if you will just be patient these birds will leave soon. I highly doubt that a tiny birds wings flapping could cause you such distress. Why not invest in some ear plugs and let nature take it's course. And once the birds are gone, block off the entrance to the hole in your roof so more birds don't take up residence there.
